In the latest entry on the Prawo.pl portal, Prof. Ryszard Markiewicz indicates when a provision of national law that is contrary to EU law should not be applied – these remarks are made in connection with the judgment of the Court of Justice of the EU in the Thelen case from 2022. “5 minutes about IPR” is a joint initiative of Markiewicz & Sroczyński and Wolters Kluwer Polska, entirely devoted to issues related to intellectual property law (i.e. copyright, industrial property and combating unfair competition). “5 minutes about IPR” texts will appear at least twice a month. The idea of this place is to take you 5 minutes to draw your attention to something that fascinates us and interests you. The articles will therefore be short, clear and, if possible, also “illustrated”. We would like “5 minutes about IPR” to become a source of knowledge about significant changes and judgments, an inspiration for discussion, and a source of new, also controversial, interpretation ideas. Above all, however, we hope that it will simply be interesting.
