Dr. Michał Markiewicz for Dziennik Gazeta Prawna: It is difficult for press publishers to defend their rights against internet search engines

This week, Dziennik Gazeta Prawna published an article by Dr. Michał Markiewicz on the relationship between press publishers’ rights and search engines using artificial intelligence to “answer” search queries.

“The problem described in the article clearly demonstrates that the recently introduced press publishers’ rights are no longer adequate to market needs. In practice, AI allows for the “bypassing” of this regulation without having to pay publishers any remuneration. In fact, it is copyright and the ability to block content for AI training purposes (TDM opt-out) that protect publishers against this new practice by search engines – of course, the problem of potentially demonstrating the use of a specific article for information purposes will remain, but that’s another issue.”
