Today, the Rzeczpospolita newspaper published an article by Nadia Senkowska which included Dr. Michał Markiewicz’s commentary on the “money sandwiches” [Polish: “kanapki z hajsem”] scandal.
Quoting the author: “Although this term is catchy, it is actually a direct translation of the English phrase. Translation alone, of course, does not exclude copyright protection for a derivative work (adaptation), but in this case, I have no doubt that neither the original nor the translation are protected by copyright. The juxtaposition of a few words does not reflect the creator’s personality. This requirement, especially after the CJEU ruling of December 4, 2025 (C-580/23 and C-795/23), seems to be a key element of European copyright law, which will allow for a rebalancing of the boundaries of copyright protection and, ultimately, a raising of the threshold for its granting.”
