Zuzanna Ochońska-Borowska: The draft bill – New obligations are coming for retail sellers!

The draft bill on combating unfair market practices and the Consumer Rights Act has been published, and it includes the following proposed amendments:

  • regarding harmonized information on the conformity of goods with the contract, as well as
  • harmonized labeling regarding durability guarantees.

If the law is adopted as drafted, starting September 27, 2026, retailers will be required to place a special label containing a QR code next to goods, which will link to comprehensive information on consumer rights regarding the conformity of goods with the contract. Importantly, this obligation applies not only to in-store sales but also to e-commerce sales.

At the same time, manufacturers who offer a durability guarantee covering the entire product for a period longer than two years at no additional cost will be able to use a special label, thereby strengthening their competitive advantage.

It is worth starting preparations for the upcoming changes now.
