J. Sroczyński for WuW No. 6/2002 – Conclusion of the OCCP proceedings against Warsaw Okecie Airport

The Office of Competition and Consumer Protection (“OCCP”) has ruled that the Warsaw Okecie Airport denied access to the market of taxi services to companies which were not successful in the tender to provide transportation services to passengers leaving the Okecie Airport. Only three taxi companies were selected, following which the losing companies accused the Okecie authorities of market foreclosure practices. The Airport claims that its intention was only to restore order in this quite sensitive area, since it was a long lasting practice of airport taxi drivers to significantly overcharge passengers. Currently, the three selected companies must stick to the official prices, set by the City authorities. The matter shall be now dealt with by the Antimonopoly Court.

The OCCP has expressed consent to a creation of a common entity by the largest two competitors on the metal packaging market. The reason for the positive assessment is the goal of the cooperation, which is the recycling activity.

The Antimonopoly Court has ruled that the national telecom operator, TP S.A., abused its dominant market position, triggering the conclusion of a subscription agreement related to the existing telephone number by the obligation imposed on the new subscriber to pay off the debts of the previous subscriber.
